1. Acceptance of the Terms
The terms of this agreement (“Terms of Service” or“Terms”) govern the relationship between you (“You” or “User”) and Suunto Oy, a Finnish company (business ID 0101084-1) having its registered office at Tammiston Kauppatie 7 A, 01510 Vantaa, Finland (hereinafter “Suunto”, or “Us” or “We”) regarding Your use of Suunto´s applications (including Sports Tracker), devices, web sites, and related services (the “Service”). Certain parts of the Service or specific services such as forums, contests, or loyalty programs can be governed by Additional Terms. Use of the Service is also governed by Suunto´s Privacy Policy and other relevant policies. Policies and Additional Terms are incorporated into these Terms by reference.
To use the Service, You must be at least sixteen (16) years of age. If You are at least sixteen (16) years of age but a minor where You live, You must review the Terms and have Your parent or legal guardian complete the registration on Your behalf for You to use the Service. The person completing the registration must be legally competent. By accepting these Terms and starting the use of the Service, You represent and warrant that You have complied with the aforementioned procedure.
BY INSTALLING, USING OR OTHERWISE ACCESSING THE SERVICE, YOU AGREE TO THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS, PLEASE DO NOT INSTALL, USE OR OTHERWISE ACCESS THE SERVICE. USE OF THE SERVICE IS VOID WHERE PROHIBITED.
Suunto reserves the right to modify the Terms at any time by posting the amended terms on the Service. You will be deemed to have accepted such changes by continuing the use the Service. If You do not agree to the changes, Your right to use the Service shall terminate, and You must immediately stop using the Service.
2. Your account
You agree to provide correct and complete information when registering and creating Your account for the Service and to keep that information updated. Providing misleading information about Your identity is forbidden.
You (and Your parent or legal guardian, if You are a minor) are personally responsible for any use of the Service with Your account. You agree to take due care in protecting Your account against misuse by others and to promptly notify Suunto about any misuse.
You shall not (or attempt to) purchase, sell, rent or give away Your account, create an account using a false identity or information, or on behalf of someone other than yourself; You shall not use the Service if You have previously been removed or banned from using the Service by Suunto.
3. Your right to use the Service
Subject to Your agreement and continuing compliance with these Terms, You have a non-exclusive, non-transferable, non-sublicensable, revocable (at the sole discretion of Suunto at any time), and limited right to access and use the Service for Your own private non-commercial purposes strictly in accordance with the Terms. You agree not to use the Service for any other purpose.
You are permitted to use of the Service on Your computer or mobile terminal, smart watch or other similar devices, as applicable, downloading the outcomes of the Service and printing copies of extracts of the content of the Service for Your personal use only and not for redistribution, unless consented to in writing by Suunto.
Any further intellectual property rights to the Service or any information or content in the Service are not granted. Reproduction, transfer, distribution or storage of part or all of the contents in any form without the prior written permission of Suunto is prohibited except in accordance with the following terms.
4. Restrictions of Use
Any use of the Service in violation of these restrictions of use is strictly prohibited. It can result in the immediate revocation of Your right to use the Service, and suspension or termination of Your account. It may also subject You to liability for violations of law. You agree that You shall not:
a) reverse engineer, decompile, disassemble, decipher or otherwise attempt to derive the source code for any underlying software or other intellectual property used to provide the Service, or to obtain any information from the Service using any method not expressly permitted by Suunto;
b) use or take part (directly or indirectly) in the use of any unauthorized third-party software designed to access, modify or interfere with the Service, or disrupt, interfere with or otherwise adversely affect the normal flow of the Service or otherwise act in a manner that may negatively affect other users' experience when using the Service;
c) use the Service for betting or any similar activity in which prizes or rewards can be won (directly or indirectly);
d) submit any unlawful, offensive, abusive, threatening, obscene, defamatory, harassing, libelous or racially, sexually, religiously, or otherwise objectionable or offensive or other inappropriate material or a link to such material;
e) attempt to, or harass, abuse, or harm, or advocate or incite harassment, abuse, or harm of another person, or group, including Suunto´s employees and representatives;
f) engage in ongoing toxic behavior, such as by repeatedly posting information on an unsolicited basis;
g) collect or post any other person´s private information, including personally identifiable information (whether in text, image or video form), identification documents, or financial information through the Service;
h) make available through the Service any material or information that infringes any copyright, trademark, patent, trade secret, right of privacy, right of publicity, or other right of any person or entity or impersonates any other person, including without limitation Suunto´s employees and representatives.
i) distribute or post spam, files or technologies that may harm the Service, or the interest or property of the Service users.
j) use the Service to advertise, or solicit, or transmit any commercial advertisements, including chain letters, junk, or spam e-mail or repetitive or misleading messages to anyone.
k) use the Service in any way that would violate any export controls, anti-money laundering rules, economic sanctions or similar laws or regulations including but not limited to those imposed by the United States of America and/or the European Union.
5. Service provision and availability
In order to be able to use certain features of an application, Your device may have to be equipped with a GPS module for workout tracking.
The Services may include heatmaps for Your convenience. Heatmaps show the tracks frequently used by the users of the Services. Please note that Suunto has not in any way checked or verified the tracks shown in the heatmaps such as their accessibility, safety or suitability for exercise. The information related to the tracks such as the total distance may be inaccurate. You understand that You use heatmaps and tracks at Your own risk and discretion.
We use advanced sensors and algorithms to generate metrics that can help You in Your activities and adventures. However, calories, heart rate, location, movement detection, stress/recovery indicators and other measurements may not match the metrics measured in laboratory conditions and are estimates only.
Your safety is important for Suunto, so before using the Services and/or our products, please read carefully our general product safety information and warnings available at: www.suunto.com/generalproductsafety.
By using the service, You represent and warrant that You have read the warnings and agree to comply with the instructions included therein.
The Service may not be available in some countries and may be provided only in selected languages. The Service may be network dependent. Contact Your network service provider for more information.
You acknowledge and agree that Suunto may, at its sole discretion change, improve and correct or otherwise update the Service with or without notifying You. You may need to update the applications as well third party software You have installed on Your device or computer in order to use the Service.
The Service may not be available during maintenance breaks and other times.
Suunto may also at its sole discretion decide to stop offering and/or supporting the Service or a particular part of the Service at any time. In such case You will be provided a prior notification. Suunto shall not be liable to provide refunds, benefits or other compensation to users in connection with such discontinuation.
6. User Material
"User Material" means any communications, images, videos, sounds, and all the material, data, and information that You upload or transmit through the Service, or that other users upload or transmit, including without limitation any chat text.
Your submission of User Material to the Service does not transfer ownership rights of the User Material to Suunto and nothing in these Terms is intended to restrict any rights that You may have to use and exploit Your User Material.
You hereby grant to Suunto and its affiliates, subcontractors and suppliers an irrevocable, perpetual, transferable, fully paid-up, royalty-free, worldwide license (including the right to sublicense and assign to third party) and right to copy, reproduce, fix, adapt, modify, create derivative works from, manufacture, commercialize, publish, distribute, sell, license, sublicense, transfer, lease, transmit, publicly display, publicly perform, or provide access to electronically, broadcast, communicate to the public by telecommunication, display, perform, enter into computer memory, and use and practice, in any way, Your User Material as well as all modified and derivative works thereof in connection with provision of the Service, including marketing and promotions of the Service. Except as prohibited by law, You waive any rights of attribution and/or any moral rights You may have in Your User Material, regardless of whether Your User Material is altered or changed in any manner.
You further hereby grant to Suunto the unconditional, irrevocable right to use and exploit Your name, likeness and any other information or material included in any User Material and in connection with any User Material, without any obligation to You.
You are solely responsible for Your User Material. By submitting User Material to the Service, You affirm, represent and warrant that:
a) the User Material is accurate and not confidential or misleading;
b) You will use reasonable efforts to scan and remove any viruses, adware, spyware, worms or other malicious code;or other contaminating or destructive features before submitting any User Material;
c) submitting the User Material is not in violation of any laws, contractual restrictions or other third party rights, and that You have permission from any third party whose personal information or intellectual property is contained in the User Material;
d) You agree not to take any action against Suunto or its suppliers in relation to the User Material that You submit, and You agree to indemnify Suunto and its suppliers if any third party takes action against Suunto or its suppliers in relation to the User Material You submit.
7. Content Screening and Reporting illegal content (EU Digital Services Act)
7.1. Content Screening
Suunto shall not be responsible for any User Material submitted by You or any other user and Suunto assumes no responsibility for monitoring the Service for inappropriate content or behavior. Suunto has no obligation but reserves the right in its sole discretion and subject to the Privacy Policy to manually or automatically (e.g. using artificial intelligence, or AI):
· monitor and/or record Your interaction with the Service or communications (including without limitation chat text, and User Material) when You are using the Service, and
· review, moderate, edit, delete, block or disable access to or otherwise make unavailable any of the User Material which violates these Terms without notice at any time.
When we remove Your User Material or suspend or terminate Your account, we will inform You via email of the reason for our action and provide You with information on any available redress options, such as how to use our internal complaint-handling system to appeal the action.
7.2. Reporting illegal content
If You see content in our Service that You believe is illegal, please report it to us at eudsa@suunto.com.
In Your report please include details of:
· The type of illegal content
· The Service where the alleged content can be viewed, URLs or other information describing the exact location of the content
· The description of the alleged content
· The explanation in detail why You believe the content is unlawful, citing specific provisions of law wherever possible
· Your full legal name, company name or government authority (if applicable), country of residence, email address (for us to contact You for the report)
Please note that we will not process Your report if the report is incomplete. If You're not reporting an illegal content issue in accordance with the Digital Services Act, we are unable to respond to Your message.
Our point of contact for direct communication with EU Member States’ authorities, the European Commission, and the European Board for Digital Services is Suunto Oy, Tammiston kauppatie 7 A, Vantaa, Finland, eudsa@suunto.com. We can receive communications to this contact in English.
8. Allegations of Copyright Infringement
Suunto has no obligation to monitor or enforce Your intellectual property rights in or to Your User Material. You may notify Suunto of copyright infringement on the Service by providing notice (a) by email with “Copyright Notification” in the subject line to legal@suunto.com, (b) by a document titled “Copyright Notification” mailed to Suunto, Attn: Tammiston kauppatie 7 A, 01510 Vantaa, Finland, or (c) via the online form, if available. Your notice must:
· Identify the original copyrighted work You claim is infringed;
· Identify the Service and the content on the Service that You claim is infringing the copyrighted work. Please provide enough detail for Suunto to locate the allegedly infringing content on the Service;
3) Provide Your contact information, including Your full name, mailing address, telephone number, and email address, if available;
· Provide a statement that You have a good faith belief that the use of the content in the manner referenced is not authorized by the copyright owner, its agent, or the law;
· Provide this statement: "I swear, under penalty of perjury, that the information in this notification and complaint is accurate and that I am the copyright owner or am authorized to act on behalf of the copyright owner of an exclusive right that is infringed."; and
· Provide Your signature.
9. Your interactions with other users
You may interact with other users on or through the Service. You agree that any such interactions do not involve Suunto and are solely between You and the other user(s). Suunto reserves the right, but has no obligation, to become involved in any way with these disputes.
You will fully cooperate with Suunto to investigate any suspected unlawful, fraudulent, or improper activity, including, without limitation, granting Suunto access to any password-protected portions of Your account.
10. Connecting to Suunto Partners and other third-party services
For Your easy accessibility, Suunto Service may include links to services that are owned or operated by third parties and that are not part of the Service. These include also Value Pack and other Suunto partners. Connecting to these third-party services is completely voluntary. Before connecting and using such third-party service, You must review and agree to the terms and conditions and privacy policies of such third-party service and consent to any sharing of your personal data with the service provider.
You agree that Suunto has no control over the content of third-party services and cannot assume any responsibility for services provided or material created or published by such third-party service providers.
In addition, users may create links within the Service to content that has not otherwise been submitted to the Service. You agree that Suunto is neither responsible for nor liable for any such links.
11. Personal Data
The Privacy Policy, as amended from time to time and available at www.suunto.com/privacy-policy, defines how, why and to which extent Suunto collects and uses personal information in relation to the Service.
12. Fees
Your use of the Service may be or may become subject to charges. Suunto may revise the fees at any time. Any fees charged by Suunto will be announced separately in connection with the Service. You agree to pay all fees and applicable taxes incurred by You or anyone using Your account.
Use of the Service may involve transmission of data through Your service provider’s network or from the use of mobile and/or internet, including without limitation SMS, MMS and WAP browsing, data transfer and other services that require the use of airtime and mobile. Your network service provider may charge for such data transmission.
Suunto assumes no responsibility for the payment of any charges, and Your operator/carrier is in every respect solely responsible for the services it provides to You.
13. Payment Services
Suunto may offer payment functionality through certain devices, including smart watches, that allows You to make contactless payments using payment cards linked to Your device. The payment service may not be available in all countries and is dependent on third-party systems including payment scheme networks and issuing bank systems, which are beyond Suunto's control.
You acknowledge that payment services involve the processing of Your payment card data and related information by our third-party service provider in accordance with applicable data protection laws and payment industry standards. The use of payment functionality is at Your own risk, and You should ensure that Your device is properly secured to prevent unauthorized use.
Payment services are subject to additional fees that may be charged by third parties, including issuing banks, financial institutions, or payment scheme networks. Suunto is not responsible for any such third-party fees. You are solely responsible for all fees, contractual obligations, and commercial terms levied by third parties in connection with payment services.
Upon termination of Your Suunto account or the payment service, payment functionality may be discontinued and payment tokens may be removed from Your device.
14. AI based Services
14.1 General rights and obligations
Suunto´s AI based Services are provided as tools to assist You with Your inquiries and needs. Responses are generated based on the data You provide and may not be suitable for all users or circumstances. When You are interacting with an AI based Service, You will be explained how the Service works, its intended role and purpose, and its main limitations as well as any profiling, decisions or recommendations made by the Service that produces legal effects or similarly significantly affects You. You may also contest such decisions and request human review where applicable. For more information on Your rights, please refer to the Privacy Policy.
The data processed by an AI based Service is used solely for the purpose of providing the Service and for improving the AI based Service. For more information on data processing and profiling, please refer to our Privacy Policy.
Suunto is committed to complying with the requirements of the EU Artificial Intelligence Act. The AI based Services are designed and operated in accordance with applicable transparency, risk management, data governance, and user rights requirements. For more information, please contact Suunto at privacy@suunto.com.
Suunto does not guarantee the accuracy, completeness, or suitability of the AI-generated responses. Use of the AI based Services is at Your own risk. Suunto's limitation of liability as set out in Section 14 applies also to all AI based Services.
14.2 AI Coach
Service may include an AI Coach that provides exercise and training advice based on Your inputs and Sport and Exercise Data, Health Data, Location Data, and other data as specified in the Privacy Policy. The AI Coach uses automated profiling techniques to analyze Your data to generate personalized recommendations and training advice.
Before using the AI Coach, Your explicit consent is needed for the processing of Your data by the AI Coach as described in the Privacy Policy. You may withdraw Your consent at any time by disabling the AI Coach or by contacting Suunto.
AI Coach is not a healthcare professional. When needed, You are responsible for consulting with a healthcare professional before following any exercise or training advice of the AI Coach.
14.3 AI based Customer Service
Service may include an AI-based customer service chatbot (“AI Chatbot”) that provides automated responses, assistance, and information based on Your queries and account data. You can switch to human customer service at any time and contest decisions made by AI Chatbot and request human review where applicable.
15. Disclaimer of Warranties and Limitation of Liability
The Service is provided on “AS IS” and “AS AVAILABLE” basis. Suunto does not warrant that the Service will be uninterrupted or error or virus-free. No warranty of any kind, either express or implied, including but not limited to warranties of title or non-infringement or implied warranties of merchantability or fitness for a particular purpose, is made in relation to the availability, accuracy, reliability, information or content of the Service. Suunto does not warrant that You will be able to access or use the Service at the times or locations of Your choosing; that the Service will be uninterrupted or error-free; that defects will be corrected; or that the Service is free of viruses or other harmful components. You expressly agree and acknowledge that the use of the Service is at Your sole risk and that You may be exposed to content from various sources.
Suunto shall not be liable for any direct, indirect, incidental, punitive or consequential damages caused by the use or inability to use the Service. Some jurisdictions do not allow exclusion of certain warranties or limitations of liability, so the above limitations or exclusions may not apply to You. The liability of Suunto and its suppliers is in such case limited to the greatest extent permitted by law.
To the maximum extent permitted by law, Suunto shall not be liable to You for any indirect, incidental, consequential, special, punitive or other similar damages, including but not limited to loss of revenues, lost profits, lost data or business interruption or other intangible losses (however such losses are qualified), arising out of or relating in any way to these Terms or the Service itself, whether based on contract, tort or any other legal theory, and whether or not Suunto has been advised of the possibility of such damages.
To the extent not prohibited by law, Suunto shall not be liable to You for more than the amount You have paid to Suunto in accordance with these Terms of service in the six (6) months immediately preceding the date on which You first assert a claim. You acknowledge and agree that if You have not paid anything to Suunto during such time period, Your sole remedy (and Suunto´s exclusive liability) for any dispute with Suunto is to stop using the Service and to cancel Your account.
Nothing in these Terms shall affect the statutory rights of any consumer or exclude or restrict any liability resulting from gross negligence or willful misconduct of Suunto or for death or personal injury arising from any negligence or fraud of Suunto.
Suunto shall not be liable for any delay or failure to perform resulting from causes outside the reasonable control of Suunto, including without limitation any failure to perform hereunder due to unforeseen circumstances or cause beyond Suunto´s control such as acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labor or materials.
16. Indemnification
You agree to defend, indemnify and hold harmless Suunto (and our officers, directors, agents, affiliates, employees and representatives) from and against any and all third party claims and all liabilities, assessments, losses, costs or damages resulting from or arising out of i) Your breach of the Terms, ii) Your infringement or violation of any intellectual property, other rights or privacy of a third party, iii) misuse of the Service by a third party where such misuse was made available by Your failure to take reasonable measures to protect Your username and password against misuse.
17. Equitable Remedies
You acknowledge that the rights granted and obligations made under these Terms to Suunto are of a unique and irreplaceable nature, the loss of which shall irreparably harm Suunto and which cannot be replaced by monetary damages alone so that Suunto shall be entitled to injunctive or other equitable relief (without the obligations of posting any bond or surety or proof of damages) in the event of any breach or anticipatory breach by You.
You irrevocably waive all rights to seek injunctive or other equitable relief, or to enjoin or restrain the operation of the Service, exploitation of any advertising or other materials issued in connection therewith, or exploitation of the Service or any content or other material used or displayed through the Service and agree to limit Your claims to claims for monetary damages, limited by Section 14 (if any).
18. Suunto´s Intellectual Property Rights
18.1 Service
All rights, title and interest and all intellectual property rights or other proprietary rights in and to the Service (including without limitation any applications, titles, computer code, application clients and server software, themes, objects, concepts, artwork, animations, sounds, audio-visual effects, methods of operation, moral rights, documentation, and user accounts) are owned by Suunto.
18.2 Trademarks
Suunto's product and service names are either trademarks or registered trade names of Suunto. Other product and company names mentioned in the Service may be trademarks or trade names of their respective owners. Your access to the Service shall not be construed as granting, by implication, estoppel or otherwise, any license or right to use any marks appearing in the Service without the prior written consent of Suunto or the third-party owner thereof.
Suunto is registered trademark of Suunto Oy. Suunto product and feature and content names are registered or unregistered trademarks of Suunto Oy. Other product and company names are trademarks of their respective owners.
Primary trademark is “SUUNTO”. Product names and slogans may also be registered. All trademarks, registered or unregistered, are owned by Suunto Oy. Ownership or registration by divisions, subsidiaries or third parties is strictly forbidden.
18.3 Domain names
The official domain names are www.suunto.com and www.movescount.com. Suunto Oy reserves the rights to all domain names containing its trademark “SUUNTO”.
If an importer feels that the local domain(s) of the suunto.com or movescount.com domain names are needed, and the domain is deemed relevant by Suunto Oy, Suunto Oy will register these domains.
All suunto.xx domains forward to suunto.com. Under no circumstances shall subsidiaries or third parties independently register versions of these domain names.
Suunto distributors, importers and dealers may host their own web sites to promote and sell Suunto products. However, the domain names may not contain the name Suunto or the names of its other trademarks. Suunto may, upon request and review, place links from suunto.com to these sites and links may be located in the importer or dealer lists.
18.4 Website and copyright
Copyright © Suunto Oy 2025. Suunto´s web sites and contents thereof are proprietary to Suunto and are intended solely for the use of its clients to obtain knowledge and information regarding Suunto products. Its contents shall not be used or distributed or otherwise communicated, disclosed or reproduced for any other purpose without the prior written consent of Suunto.
19. Suspension and Termination of Your Account and Service
You may terminate Your account if You no longer wish to use the Service through the self-service portal within Your account settings or by submitting a written request to support-en@suunto.com. After termination, You will no longer have access to the Service.
Without limiting any other remedies, Suunto may limit, suspend, terminate, modify, or delete Your account or restrict Your access to certain parts of the Service or take any other action of whatsoever nature, as it may deem appropriate at its exclusive discretion if there is an indication that You have breached these Terms.
Suunto may terminate Your account with prior notice if it has been inactive for the past twelve (12) months.
Except as set forth in Privacy Policy, Suunto shall not be responsible for any removal of Your User Material from the Service when Your account is terminated.
You acknowledge that after Your User Material is removed from the Service by either You or Suunto, some traces of the User Material may remain, and copies of the User Material may still reside within the Service.
20. Choice of Law and Arbitration
Except where prohibited by applicable law or provided otherwise herein, the Terms shall be governed by the laws of Finland without regard to its conflict of law provisions.
You agree to abide by applicable export control laws in the USA and other countries and not to transfer or make available, by electronic transmission or otherwise any content, software or materials subject to restrictions under such laws to a destination prohibited by such laws.
If You are a US resident the following paragraph shall apply:
The Terms shall be governed by the laws of Delaware without regard to its conflicts of law provisions. Any dispute relating to these Terms or the Service shall be submitted to binding arbitration in Delaware within eighteen (18) months of the date the facts giving rise to the suit were known, or should have been known, by the complainant, except that Suunto may seek injunctive or other relief if You have violated or threatened to violate any intellectual property rights. All matters relating to arbitration shall be governed by the Federal Arbitration Act (9 U.S.C. §1 et. seq.). Arbitration shall be conducted by a single arbitrator under the then prevailing Wireless Arbitration Rules of the American Arbitration Association (“AAA”). Each party must submit any claim which would constitute a compulsory counterclaim in litigation or such claim shall be barred. No award of exemplary, special, consequential or punitive damages shall be permitted. The losing party, as determined by the arbitrator, shall pay the arbitration fees. The arbitrator's award shall be binding and may be entered as a judgment and enforceable in any court of competent jurisdiction. Arbitration shall be conducted on an individual, not class-wide basis, and no arbitration shall be joined with an arbitration involving any other person or entity.
21. Validity and Entire Agreement
The Terms shall neither exclude nor limit any of Your mandatory rights in Your country of residence. If a provision of the Terms is found to be invalid, the validity of the remaining provisions shall not be affected, and the invalid provision shall be replaced with a valid provision that comes closest to the result and purpose of the Terms. The provisions of the Terms that are intended to survive termination shall remain valid after any termination.
The Terms, including any Additional Terms and Policies and any documents expressly incorporated by reference herein, contain the entire understanding of You and Suunto, and supersede all prior understandings of the parties hereto relating to the subject matter hereof, whether electronic, oral or written, or whether established by custom, practice, policy or precedent, between You and us with respect to the Service.
22. No Waiver
The failure of Suunto to exercise any right under these Terms shall not be construed as a waiver or relinquishment of Suunto´s right to assert or rely upon any such provision or right in that or any other instance.
The express waiver by Suunto of any provision, condition, or requirement of these Terms shall not constitute a waiver of any future obligation to comply with such provision, condition or requirement.
Except as expressly and specifically set forth in these Terms, no representations, statements, consents, waivers, or other acts or omissions by Suunto shall be deemed a modification of these Terms nor legally binding, unless documented in physical writing, hand signed by You and a duly appointed officer of Suunto.
23. Assignment
Suunto may assign or delegate this agreement (Terms of Service) in whole or in part, to any person or entity at any time with or without Your consent. You may not assign or delegate any rights or obligations under this agreement without Suunto´s prior written consent, and any unauthorized assignment and delegation by You is ineffective.
You agree that in the event that Suunto is acquired by or merged with a third-party entity, or we transfer the Service to a third party, we reserve the right, in any of these circumstances, to transfer or assign the agreement with the user and transfer all data, including but not limited to personal information, as part of such merger, acquisition, sale, transfer or other change of control.
